Terms of Use

1. Acceptance of terms

These Terms of Use ("Terms") are an agreement between you and Bifyo LLC ("Bifyo," "we," "us") governing your access to and use of bifyo.com and the Bifyo application (together, the "Service"). By creating an account or otherwise using the Service, you agree to these Terms. If you're using the Service on behalf of a company, you're confirming you have authority to bind that company, and "you" refers to that company.

If you don't agree to these Terms, don't use the Service.

2. The service

Bifyo provides location intelligence and feasibility analysis for business site selection: an Opportunity Score and Feasibility Score for a given address, business category and radius, built from a mix of live third-party data (U.S. Census, Google Places, FEMA, OpenStreetMap) and Bifyo's own scoring model. Every figure on a report is labelled either REAL (pulled directly from a named public source) or an AI/model-based estimate - see the Help centre for the full methodology.

Scores describe market conditions at a location. They are not a guarantee, prediction, or endorsement of any business outcome - see Section 8.

3. Accounts

• You must provide accurate information when creating an account and keep your password (or, for Google sign-in, your Google account) secure. You're responsible for everything that happens under your account.
• You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account.
• Tell us right away at Contact us if you believe your account has been compromised.
• We may suspend or terminate an account for violating these Terms, fraudulent activity, or non-payment. See Section 10.

4. Report packs & billing

Bifyo is sold as one-time report packs (a single report or packs of several reports), with no subscription - see Pricing for current rates and what each includes, and the Payment Policy for credit validity and refunds, which forms part of these Terms. Payments are processed by Stripe; we never see or store your full card number.

• Each report credit buys one full report and is valid for 12 months from purchase; unused credits expire after that.
• Nothing renews automatically - you are only charged when you buy a pack.
• Fees are non-refundable except as set out in the Payment Policy or where required by applicable law.
• We may change pack prices going forward; credits you have already bought are not affected.

If you were referred by a Bifyo affiliate, that affiliate earns a commission on your purchases as described in the Affiliate Program terms - this has no effect on the price you pay.

5. Acceptable use

You agree not to:

• Scrape, crawl, or systematically extract data from the Service beyond normal use of your account, or use automated means to access it without our written permission.
• Resell, sublicense, or redistribute Bifyo's reports, scores, or underlying data as a standalone product or data feed to third parties.
• Reverse-engineer, decompile, or attempt to derive the source code or scoring logic behind the Service.
• Use the Service to build a competing product, or in any way that violates the terms of the third-party data sources it relies on (see Section 7).
• Interfere with or disrupt the Service, attempt unauthorized access to any account or system, or introduce malware.
• Misrepresent your identity, impersonate another person or entity, or use the affiliate program through fraudulent referrals, self-referrals, or fake accounts.
• Use the Service for any unlawful purpose.

6. Your content

You retain ownership of the content you submit - business concept descriptions, saved locations, support messages, and similar. By submitting it, you grant Bifyo a license to use it solely to operate and improve the Service (for example, to generate your report or respond to your support ticket). We don't sell your content, and we don't use it to train models offered to other customers.

Reports generated for your account are yours to use, including sharing with investors or lenders, subject to these Terms and any plan limits on branding or export shown at Pricing.

7. Third-party services & data sources

The Service pulls in, or relies on, data and infrastructure from third parties, including the U.S. Census Bureau, Google (Places, Maps, and Google Sign-In), FEMA, OpenStreetMap, and Stripe for payment processing. Each of these is governed by its own terms and privacy practices, which we don't control. Google Places / Maps content in particular is subject to Google's own Maps Platform terms and may not be cached, exported, or redistributed beyond what those terms allow.

8. Disclaimers

THE SERVICE, INCLUDING ALL SCORES, REPORTS AND ESTIMATES, IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

A high Opportunity Score or Feasibility Score describes market conditions at a location - demand, competition, growth, accessibility, and financial modeling based on available data. It does not measure your operating skill, product quality, hiring, timing, or execution, and it is not a guarantee that any business will succeed at that location. AI-generated content (competitor summaries, SWOT analysis, regulatory research) is a synthesis of available information and may be incomplete or inaccurate - verify anything you rely on for a real financial decision.

Bifyo is not a licensed financial, legal, or real estate advisor, and nothing in the Service constitutes such advice.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIFYO LLC AND ITS OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF THE SERVICE OR A DECISION MADE IN RELIANCE ON IT - INCLUDING A LEASE, PURCHASE, OR INVESTMENT DECISION - EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

BIFYO'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID BIFYO IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

Some jurisdictions don't allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

10. Termination

You can stop using the Service at any time; there is no subscription to cancel. We may suspend or terminate your access if you violate these Terms, on non-payment, or if we discontinue the Service, with notice where reasonably possible. Bifyo currently has no fully self-service "delete my account" button - contact us to request full account deletion, and we'll confirm once it's done. Sections that by their nature should survive termination (Disclaimers, Limitation of Liability, Governing Law) do.

11. Changes to these terms

We may update these Terms as the Service evolves. If a change is material, we'll make reasonable efforts to notify active account holders (such as an in-app or email notice) before it takes effect. The "Last updated" date at the top of this page always reflects the current version. Continuing to use the Service after a change takes effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-laws principles. Any dispute arising from these Terms or the Service will be brought in the state or federal courts located in Wyoming, and you consent to that jurisdiction.
